One of South Africa's most significant class actions in legal history. Abrahams Kiewitz Inc. represented tens of thousands of current and former gold mine workers — and the dependants of deceased miners — who contracted silicosis and tuberculosis as a result of exposure to silica dust in the mines. The case established a historic precedent for occupational disease litigation and access to justice for vulnerable workers.

Answers to common questions across our practice areas — written in plain language to help you understand your legal position before reaching out.
The Magistrate's Court handles civil claims up to R400,000 and most criminal matters, and is generally faster and less costly. The High Court has unlimited civil jurisdiction and hears complex, high-value, or constitutionally significant matters — including appeals from the Magistrate's Court. For matters involving constitutional rights, class actions, or significant financial stakes, the High Court is typically the appropriate forum.
Abrahams Kiewitz Inc. practises at both levels, as well as the Supreme Court of Appeal and Constitutional Court. Speak to us about your matter.
A class action allows a large group of people with the same legal grievance to sue collectively as a single plaintiff group, rather than each person litigating separately. It is a powerful tool for holding corporations and institutions accountable where individual claims would be too costly to pursue alone. South African class action law has evolved significantly through public interest litigation — including the landmark Silicosis Class Action and Bread Price-Fixing Class Action.
If you believe you may be part of a group suffering a common harm, contact us to assess your position.
Conveyancing is the legal process of transferring ownership of immovable property. It covers the preparation and lodgement of transfer documents, registration and cancellation of mortgage bonds, sectional title transfers, and compliance with SARS and municipal clearance requirements. In straightforward transactions the process typically takes six to ten weeks from instruction to registration, though delays can arise from outstanding rates clearances, bond approvals, or estate complexities.
We are a registered service provider to most South African commercial banks. Ask us about your property transaction.
South African administrative law guarantees every person the right to lawful, reasonable, and procedurally fair administrative action. If a government body — such as a municipality, licensing authority, or procurement office — has made a decision that prejudices you, that decision may be challenged through a judicial review in the High Court. Grounds for review include bias, procedural irregularity, acting outside lawful authority, or making an irrational decision.
Our Constitutional and Administrative Law team advises on review rights across sectors. Tell us about your situation.
Business rescue is a formal process under the Companies Act 71 of 2008 designed to rehabilitate a financially distressed company. Once commenced, a moratorium takes effect — creditors are generally prevented from enforcing claims or taking legal action while the rescue is underway. A business rescue practitioner is appointed to develop a plan, which creditors, employees, and shareholders all have defined rights to vote on. Whether you are a distressed company, a creditor seeking to protect your position, or a party affected by the process, early legal advice is critical.
Our insolvency and restructuring team can guide you through the process. Contact us at the earliest stage.
Estate planning should begin as soon as you have assets, dependants, or a business interest — not only later in life. A sound estate plan includes a valid and updated will, nomination of beneficiaries for life policies and retirement funds, consideration of trusts for asset protection or minor beneficiaries, and tax-efficient structuring of your estate. Without a valid will, South African intestate succession laws determine who inherits — which may not reflect your wishes or protect the people who depend on you.
We assist with wills, trusts, and estate administration. Arrange a confidential consultation today.
